“In accordance with SEC Rule 17a-4, firms must retain all incoming and outgoing communications related to their firms business as such. Also, under NASD Rules 2210 and 2211, firms must retain all communications for a period of three years from the date of last use. For example, if an RR (registered representative) maintains a business related Web site, all information posted on the site must be captured and retained by the broker dealer.”

According to FINRA’s regulatory notice 10-6 of January 2010, your firm is responsible for keeping records of corporate and employee communications on social networks like Twitter, Facebook and more. The notice states clearly:

  • Firms must keep records of all social media communications: “Every firm that intends to communicate, or permit its associated persons to communicate, through social media sites must first ensure that it can retain records of those communications.”
  • Firms must supervise their employees’ communications on social media sites: “firms must supervise these interactive electronic communications under NASD Rule 3010.”
